Hosp, Gilbert & Bergsten obtains a defense verdict in an auto vs. pedestrian case.
Plaintiff, a 45-year old homemaker, was pushing a shopping cart along the crosswalk when she was struck by defendant’s pick up truck making a left a turn. Plaintiff alleged that the truck driver was negligent for being inattentive and failing to yield to a pedestrian. The defense successfully demonstrated to a jury that the truck driver did not have enough time to react to plaintiff’s decision to enter the road.
